Chapter 7 Bankruptcy
Also called liquidation or straight bankruptcy, Chapter 7 bankruptcy wipes out your unsecured debts such as credit cards, charge cards and medical bills.
- You will not have to pay that money back.
- You will not lose everything. Most people are allowed to keep most of their assets.
- You won't have to be afraid to answer the phone, because creditors must stop calling and halt all collection actions as soon as you file.
You cannot discharge secured debts (such as a mortgage or car payments), student loans or child support. However, by eliminating your other debt, you should be able to meet those obligations and can begin to rebuild your damaged credit rating.
Those who do not qualify for Chapter 7 can still pursue Chapter 13 bankruptcy, which gets creditors off your back while you to repay debts over time.
We will take the time to explain the process, answer your questions and address your fears about who will know or life after filing bankruptcy.
The "new" law: Congress changed the Bankruptcy Code in 2005, requiring an income means test and additional documentation. Most people who would have been eligible before will still qualify for Chapter 7 bankruptcy. The law also requires a credit counseling course before filing and a financial management course before your debts are discharged. We can help you find an approved agency — the courses can often be done over the Internet.
There is no shame in bankruptcy. Hundreds of thousands of people file for Chapter 7 bankruptcy every year — honest, working Americans like you who gradually got in over their heads.
